Terms of Service

These Terms of Service ("Terms") govern your use of TuckR89 Cloud, an account-based cloud-storage service operated by TUCKR89 LLC ("TuckR89," "we," "us," or "our"). By creating an account or using the Service, you agree to these Terms.

1. Eligibility

You must be legally capable of entering into a binding agreement and meet any minimum age required by applicable law. If you use the Service on behalf of another person or organization, you represent that you have authority to bind them.

2. Accounts

You are responsible for providing accurate account information and maintaining access to your registered email address. You may not create accounts for fraudulent, abusive, unlawful, or unauthorized purposes.

3. Account security

You are responsible for safeguarding passwords, recovery codes, passkeys, authenticated devices, and other credentials associated with your account. Notify us promptly if you suspect unauthorized access.

4. Acceptable use

You may use TuckR89 Cloud to store and retrieve files you have the legal right to possess, store, and process. Your use must comply with applicable laws and these Terms.

5. Prohibited content and activity

You may not use the Service to distribute malware, conduct unauthorized access, facilitate fraud, abuse other users or infrastructure, interfere with service operation, evade quotas or security controls, or store/distribute content where doing so is unlawful. We may investigate and act on suspected abuse.

6. Your responsibility for uploaded content

You retain responsibility for files you upload, including their legality, accuracy, and any rights required to store or process them. You should maintain independent copies of critical files.

7. Intellectual property

You retain ownership of your content. TuckR89 and its licensors retain rights in the Service, software, branding, documentation, and related intellectual property.

8. Limited license to process your content

You grant us a limited, non-exclusive license to host, store, reproduce, transmit, replicate, verify, recover, and otherwise process your content solely as reasonably necessary to provide, secure, maintain, troubleshoot, and improve the Service or comply with law.

9. Storage plans and limits

Each account is subject to its applicable storage quota and other technical limits. Uploads that would exceed a quota may be rejected. Plan details may change prospectively, subject to applicable law and store requirements.

10. Subscriptions and recurring billing

Paid storage plans may be offered as recurring subscriptions. Where purchased through Google Play or Apple's App Store, billing, renewal, cancellation, taxes, currency conversion, and refunds are also subject to the applicable store's terms.

11. Cancellation

You can cancel app-store subscriptions through the applicable store account. Cancellation normally stops future renewal; it does not necessarily provide a refund for an already-paid period unless required by law or store policy.

12. App-store purchases and refunds

Refund requests for purchases processed by Google Play or Apple may be subject to the applicable platform's policies and processes. TuckR89 may also take actions necessary to reconcile entitlements after refunds, reversals, expirations, or chargebacks.

13. Trash and recovery

Deleted files may enter Trash or a recovery workflow and may be restorable during the applicable recovery window. Recovery features are provided as a convenience and are not a substitute for maintaining independent backups of important files.

14. Suspension and termination

We may restrict, suspend, or terminate access when reasonably necessary to address fraud, abuse, nonpayment, legal requirements, serious security risks, or material violations of these Terms. Where appropriate, we may provide notice and an opportunity to resolve the issue.

15. Service changes

We may modify features, plans, infrastructure providers, technical limits, or supported platforms as the Service evolves. We will not advertise unfinished features as available.

16. Availability

We work to provide reliable service but do not guarantee uninterrupted or error-free availability. Maintenance, provider outages, security incidents, network issues, or events outside our reasonable control may affect access.

17. Backups and data-loss risk

TuckR89 Cloud uses protection mechanisms such as integrity verification and secondary replication where implemented, but no storage system can guarantee that files can never be lost, corrupted, or unavailable. Maintain independent copies of critical data.

18. Disclaimers

To the maximum extent permitted by law, the Service is provided on an "as is" and "as available" basis without warranties that are not expressly stated in these Terms. Nothing in these Terms excludes warranties or rights that cannot lawfully be excluded.

19. Limitation of liability

To the maximum extent permitted by law, TuckR89 will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, business, goodwill, or data, arising from use of the Service. Any limitation applies only to the extent permitted by applicable law.

20. Indemnification

Where legally permitted, you agree to indemnify and hold TuckR89 harmless from claims arising from unlawful use of the Service, infringement caused by content you upload, or your material violation of these Terms.

21. Governing law

The governing-law jurisdiction has not been configured in this public template. TUCKR89 LLC should set this field after confirming the appropriate jurisdiction with legal counsel. Mandatory consumer-protection rights remain unaffected.
